The Fiji Sun has reported that Fiji Television Limited is challenging the
legality of the presidential promulgation last year that took away its tax
exemption status. The constitutional redress application was first
mentioned in Justice Davendra Pathik’s chambers yesterday and lists the
Commissioner for Inland Revenue and President Ratu Josefa lloilo as
respondents.

Outside court, Munro Leys lawyer representing Fiji TV, John Apted said his
clients were exempted from paying tax by an Act of Parliament before the
forceful overthrow of the Soqosoqo Duavata ni Lewenivanua-led government.

The constitution clearly says that laws are made by the Parliament. The
pieces of paper purporting to do otherwise should be challengeable. Let’s
hope that Fiji TV refuses to pay and so makes the illegal regime prove
that its actions are legal, instead of citizens having to prove to courts
that their actions are illegal.

The hotels should do the same with the turnover tax increase. Just
don’t pay and make the illegal regime prove its actions are legal.

    I’m of the view that all cases before the courts that is challenging the legality of the IG (together with their enactment of laws etc) should await the ruling of the Qarase trial and presiding judges on these cases take their cue from there. But then again these judges were ‘IG appointed’… and they might do a 180degrees turn just like Justice Gates.

    As for landowners…. you know very well they are not exempt from taxes. Those who earn above the tax threshold, pay their taxes.

    Tell us, when will the PAC audit the RFMF regimental funds?

    By how much did RFMF blow their 2006 and 2007 budget, contributing to Fiji’s -4.4% economic contraction in 2007?

    How much is the Charter actually costing with teams from Agriculture, Health, Labour, Regional Development etc ALSO doing awareness work on the charter farter, AT TAXPAYERS EXPENSE – add this to the $2.6m allocated to NCBBF.

    And how much has actually been TRANSFERRED to the Elections Office by Finance SO FAR in 2008, for elections preparations?

    How much has the Constituency Boundaries Commission actually received so far in 2008? compared to how much the NCBBF has used with 3 Council meetings and numerous NTTs meetings?

    And we don’t need the budgeted amount for elections, we want to know whether the IG has actually released much needed funds to the Elections Office in the first quarter of 2008!

    And how many staff from how many ministries are up there in parliament – you’ve compromised service delivery in all those govt ministries in involving them in this drain on taxpayers funds, an illegal charter exercise. Just like your charter song – dud words, dud tunes, dud song!

    Maybe them lawyers who believe that the court appointments were all illegal – maybe they should stop appearing in courts that are presided by these “illegally” appointed judges.

    How much taxes to John Sami paid in 2008 – well according to media reports, he wasn’t paid for his services for the first 10 month – since there was not income, I guess there would be not income tax – dah!.

    The also reported what his gross pay was and what was his take home pay – so why don’t you do the math and figure out how much taxes the dude paid.

    As for the cost of charter – you think it will cost more than what Qarase blew on the Agriculture scam. Or how about them earlier bank collapse.

    The only reason FijiTV wasnt paying taxes was because Qarase and his stooges all had Class A shares in FijiTV via Fiji Holdings. By not taxing FijiTV’s revenue, the dividen payout to these thieves was higher.

    Why shouldn’t FijiTV be asked to pay taxes like all hard working men and women of this country? Simply because it is backed by a group of Taukei symptahizers who cant make money legitmately like the rest of the people in this country?

    How typical of Chodo to refuse to pay taxes on his millions stashed overseas (money which was supposed to be spent on the Indo-Fijian community, by his own admission) and then command everyone else to pay taxes like the hypocrit he is.

    You nut! FHL doesn’t own 51% of Fiji TV.

    To setup in Fiji, NZ One was given the tax exemption in 1990 – because of all the costs and the fact that they wouldnt make a profit for the next decade. Govt had 51% of the Fiji TV shares. Would it make sense for a govt owned company to pax tax bak to govt when the company was setting up? That was the deal negotiated by SVT Rabuka in the 1990s idiot.

    Regardless, its about the LAW and the CONSTITUTION nitwit! Parliament enacted that tax exemption – so ONLY parliament can remove it, not an illegal interim govt in power thru guns making a DECREE.

    Its the LAW stupid! You know, that thing about following RULES and giving investors CERTAINTY and PREDICTABILITY?? For CONFIDENCE in the country and the ECONOMY, to encourage INVESTMENT (both local and foreign)
