Another Interesting Observation!!!

This Chaudary case has opened up a new area for the CIR - henceforth any Tom Dick and Harry can have a payment paid into an offshore account, have a letter endorsed by the payer saying that it is a “gift” and the CIR cannot asses it for an income tax - Chaudary’s case has set down the precedent - thats why the RBF just received so many calls over the last twenty four hours.

and if you open up an offshore account and get all the money paid in to that account - thats not in breach of the Exchange Control Act !

interesting times ahead - guys will exploit this loophole to the hilt - claim instability in the country as being the basis for keeping huge payments offshore and put them down as gifts.

this is what happens when the CIR stops short of examining that letter from Haryana, tracking down the transaction (series of transactions) that led to the collection of the funds, identify the source transaction for those funds and where they came from - that would then have allowed the CIR to properly characterise those funds as either income or gift.

we now have a new loophole in the tax regime.

they showed clips of the report on Fiji TV last night. something is not right here.

these guys came in on Friday evening and started their inquiry. they spoke to various people. they would have looked through the tax files - and looking through tax files is not a simple process - tax audit files are some of the most technically challenging and complex types of files to look through because its a mixture for forsenic accounting and tax law - thats why it takes time to go through audit files and thats why its always best practice to have the auditor available to explain actions taken - its not an open and shut process.

coming fresh to an audit file - even if you are experienced and know what you are looking for - you need time to adjust to the rythem and the tempo of the file - to put it together - to familarise yourself with the file. every tax audit file has its own tempo and rythem and information. adjusting to a tax audit file doesn’t happen in a day or two days - the morass of information, correspodances and technical details involved is huge.

they would have sat down to discuss the issues and then they would have worked through the mass of facts involved - before coming to conclusions.

the report that was shown on the TV last evening is a 15 page report together with appendices (which probably makes it somewhere around 30 to 50 pages long), well set out, and complete - somehow i don’t believe that thing was done in the four days they were here - usually these things are done first in draft format, then they go through it and do ammendments and corrections, then its tabled before the committee for the final run through before its endorsed.

these guys did their inquiry between Friday and Sunday and had the report finished and complete by Monday evening.

if they had a Secretariat, where was it based ? who supplied the printers, photocopiers, computers ? who did the typing ? who supplied the A4 papers ?

was it being done/ already completed in Minter Ellisons Brisbane office and simply emailed over on pdf format ?

something is not right here.

this report looks like it was prepared well before hand, and either someone came here with it on a USB and just printed it out or it was done offshore and emailed over on PDF format - it was not prepared on the weekend.
the revelation that the Minter Ellison guy was involved in Momi, hired to advise Chaudary, only makes this thing more suspcious.

all this only points towards this Inquiry being a sham.

but more than that we have to look at the Minter Ellison connection to this thing - i.e the 2006 coup d’etat. Minter Ellison is not new to Fiji, in fact after the 1987 coup d’etat they had their guys working with the regime (and later the SVT government) and were moving to take over all the governments legal work - this was at the time of Attorney General Bulewa and Solicitor General Mataitoga. that initiative was only stopped as a result of preassure from the old guys in the Law Society at the time.

Minter Ellison have always been lurking in the background throughout past instability in this country. they are not new.

the question that needs to be asked is : who is behind Minter Ellison ? they are already involved with the advices that have brought the Momi project to a standstill, and Momi is probably going to go up on foreclosure very soon through the FDB - the question is simple - who is going to get the benefit of any foreclosure over Momi ? are Minter Ellison or any of their clients going to get in on the bid ? are Minter Ellison setting up for other projects in the country eg the gold mines, timber and other major projects ?

what is Minter Ellisons connection to this thing that makes them so prepared to stick their neck out and be hired by an illegalregime (Prime Minister Kevin Rudd’s words) become a party to a sham Inquiry all to cover up for Chaudary ?

this is more than just about the legal fees on an Inquiry - these guys wouldn’t fly 3000 kms to Fiji for a $150k weekend just to stick their necks out and tarnish their reputation - they get that kind of dough in Aussie and much more from their clients without putting at risk or sacrificing their credibility, integrity and reputation.

this is about a lot more. a lot lot more.

    I see in the Fijity Times this A.M. that Mr Qarase did not ask for foreign intervention but simply enquired about the options were he to eventually ask for intervention . I remember some time ago explaining this on the Fiji Times site .     The grass root Fijian benefitted from FHL.The shares were purchased from individuals, Mataqali,Tikina and yasana.They are now enjoying the dividens for the development of their lives and villages.

    This was a step in the right direction to close the economic gap between the Fijian and other races.

    One of the inquiry team members on the report of Interim Finance Minister Mahendra Chaudhry, Bruce Cowley, maintains, in respect of the Income Tax Act, the committee found that FIRCA’s tax assessments were carried out in accordance with the law.

    In an interview with Fijivillage News, Cowley said from Brisbane that Chaudhry had penalties imposed on him for not declaring the correct income and these penalties were calculated at the rate of 10% of the unpaid tax.

    Cowley added that this is consistent with FIRCA’s published policy on the imposition of penalties for undeclared income and its own internal policy for imposing penalties in respect of undeclared interest income.

    As for Chaudhry’s overseas accounts, Cowley said the team concluded that it was reasonable for FIRCA to reach the view that the principal monies paid into Chaudhry’s account were not taxable because they were paid into that account by the Indian Consul on behalf of a group in India who had collected the funds to assist in his resettlement to Australia following the events of May 2000.

    He again confirms that Chaudry did evade taxes… But they were asked to advise wether FIRCA follwed the law, not about had Chaudry broken it>> They were not even asked to report on Chaudry’s behaviour, only FIRCA.

    The inquiry should have dug up details of the money collected in Haryana. All that these investigations are going by is the letter from Haryana which explained the intended use of the money personally to Maiya Chodo.

    Nobody has even spoken to the mystery guy who wrote that letter.

    The questions to ask are:-

    - Who contributed to the fund?
    - What was the purpose of the fund that was explained to the people who contributed to the fund?
    - Who is the guy who signed this important letter which stated that the fund is for Maiya Chodo’s move to Australia?

    There are many other questions which should be asked in relation to the famous letter written in the hindustani language. The inquiry should have zeroed in on all these aspects to satisfy the people of Fiji.

    I am really happy that the tax evasion defamation case is going to court. From there MC will be scrutinised in detail on the SOURCE of funds. What we have been told is that he has managed to obtain a confirmation from HARYANA that they had given the money for personal use…OH..OH .. hold it there boy, you told FIRCA initially that the funds were held by you in TRUST? Now he is saying that the donors have confirmed that it was for him personally…someone is lying here.

    From an auditing standpoint, it is very difficult to round up a case of this nature in a weekend. Obtaining names of each donor from India would take months I am sure..The donors is a number of individuals who should be holding a receipt for the amounts being donated. We very much doubt that the donor was a single organisation or individuals.

    By the way, when did Taufa became an auditor? I am sure she must have been struglling completing her personal returns which could be done within 2 minutes….

    From the FT perspective, I am sure that this would be an area where they will be targeting and the process involved in tax auditing would also be an area of concern…Lets cheer them up people….they will crack when the crunch time comes…

    Come on idiot - the issue here was that if the money in Chaudary’s account was his personal funds, then taxes should be paid on any interest earned. Chaudary’s contends that the money was being held in trust.

    So the case would hinge on whether technically Chaudary can prove that the money was in trust (including showing whether there was a trust account set up etc).

    River Diamonds has sold a 24.8% stake to Templar Minerals, as it progresses plans to revive the Emperor Gold Mine in Fiji, which may produce 100,000 ounces of gold annually.

    New-kid-on-the-block, Templar Minerals Ltd, has snatched 24.8% of AIM-quoted River Diamonds PLC, as the UK-based mining company moved forward with reviving Fiji’s Emperor Gold Mine which has a potential of producing 100,000 ounces annually.

    Formed earlier this year, Templar Minerals paid £3.75 million for 250 million ordinary shares at the placing price of 1.5p per share.

    By Thursday, River Diamonds PLC had gained 18.60% or 0.40 pence to trade at 2.55 pence per share, bringing the company’s market capitalisation to £21.385 million, as the market reacted to the news that it had raised funds for the gold mine.

    “It’s just an investment,” Kiran Morzaria, River Diamonds PLC’s finance director, was quick to say when contacted by Mineweb. “Templar Minerals does not have board positions. We are still going to discuss with them as to how we will cooperate on the gold mining project.”

    Ironically, David Lenigas, the Chairman of Templar Minerals, served as manager of Emperor Gold Mine between 1989 and 1992.

    In late September River Diamonds PLC announced that it was raising its indirect stake in the Emperor Gold mine by upping its stake to 20 pct from 12.5 pct in Viso Gero Inc, which indirectly owns 94 pct of the mine.

    Morzaria said Thursday £1.75 million of the total proceeds would be used to subscribe for the 7.5% of shares in Viso Gero Inc, while the remaining £2 million would be used as working capital.

    The Emperor Gold Mine’s assets include four mining areas with three shafts serviced by recently refurbished mine winders, pumps, hoists and associated equipment necessary to operate a 140,000 ounce per year underground mining operation.

    It is one the longest continuously-operating high grade mines in the world with an operational history that extends over 70 years. The mine commenced production in 1936 and has produced approximately 7 million ounces of gold.

    The mine was placed on care and maintenance in December last year due to corporate problems with its previous owner’s gold hedging book and non related issues. At that time, it had a JORC approved underground delineated gold reserve of 858,000 ounces within a total gold resource of 4.76 million ounces grading 9.1 grams per ton.

    “In 70 years, the mine has never made a profit and we intend to change that,” Morzaria told Mineweb. “We don’t have hedge books and we will take advantage of the current high gold prices.”

    Morzaria also said the Emperor Mine had not made a profit because of conditions set by the Fiji military government on the previous owners, DRD, that they employ 2000 Fijians at the operation.

    In August, River Diamonds PLC’s unit Westech Gold Pty Ltd signed a deed with the government of Fiji that grants several key concessions to the Emperor Gold Mine, which are a key step in returning the mine to production.

    “We will reduce the work load to 700 people from the historical 2,000, but we are looking into where we will place the remaining 1300. No-one will be made redundant,” he said.

    Last week River Diamonds said that mining operations at the Emperor Mine have restarted with the re-commissioning of the two main production shafts, adding the mine rehabilitation is progressing well with ore production commencing before the end of the month.

    It also said the commissioning of the processing plant would be completed before the end of the year and the company was anticipating producing about 400 ounces of gold from material left in the mill circuit as part of the treatment plant re-commissioning.

    I’m no expert on tax but I can read legislation. Let me share with you what I found when I dipped briefly into the relevant legislation in Fiji. Under the FIRCA Act the CEO of FIRCA holds the powers of the Commissioner for Taxation under the Income Tax Act. These powers, not unexpectedly include powers to exercise discretion. Naturally these powers are subject to appeal rights, ample appeal rights. But these appeal rights are premised on the assumption that the taxman is going to try to assess the taxpayer as liable to pay more than the Income Tax Act requires. They don’t envisage that the taxman will exercise his unqualified discretion to let off delinquents.

    The powers give to the CEO of FIRCA include the broadest possible
    discretion:

    “^8. The Commissioner shall not be bound by any return or
    information supplied by or on behalf of a taxpayer and,
    NOTWITHSTANDING SUCH RETURN OR INFORMATION, or, if no
    return has been made, THE COMMISSIONER MAY DETERMINE
    THE AMOUNT OF THE TAX TO BE PAID BY ANY PERSON.”

    It looks to me like the new CEO, not the original one fired by Chodopu$$, may have exercised his discretion and accepted whatever story the Chodopu$$ had put up. He can do it. But is it legal? Is it transparent or defensible? These are different questions and we should not expect any answers from the dictatorship.

    A quick read of the report by the three amigos who looked at the FIRCA files suggests that the new CEO. Tikolevu, may have made the assessment. The report simply described the decision not to treat the principal sums remitted to Australian accounts as income as ‘reasonable’, (t does not reveal the basis for the decision, nor when it was made; If was clearly ‘reasonable’ from the point of view of Chaudhry. Was it also ‘reasonable’ from the point of view of FIRCA’s obligation to collect taxes?

    In relation to funds deposited about the same time in New Zealand the report states: “FIRCA files do not disclose the basis on which they concluded that funds paid into the New Zealand term deposits were not taxable”. It also defends this omission by saying that the amounts were not as large as the Australian deposits. This surely indicates which way the three amigos were willing to lean in looking at this case.

    The essential point is when was the assessment on tax on the monies from India made. If it was made while Chaudhry was illegally occupying the position of minister responsible for FIRCA, this is yet another scandal proving that the clean-up excuse for the coup that has ruined Fiji is a hollow lie.
