Or is it the pig that is getting more confused or maybe does not even know what his piglets are doing behind his back!

Today we were forced to again listen to the mad pigs raving accusing everybody left right and centre on Radio Fiji One while being interviewed by Solo Lewanavanua that we were all conspirying against the snake and not being fair.

I went to afternoon service and when I come back, guess what??? One of his piglet’s Aiyaaarse announces that the illegal PM has appointed an independent 3 man committee to investigate the snake and his tax avoidance.

How can the committee be independent when the pig was just defending the snake at midday we sat down to enjoy our fish and ota with miti lunch and by the time we tucked into our vudi vakasoso for desert he’s appoints a committee as independent investigators of what he was just trying to defend?

How bizarre???

    Independent my foot. We have in the midst of the “independent” members Bole’s old flame yadre toso Taufa Vakatale. How much more independent (not) can you get. Whatever these people in the ig does has no credibility and everything is tainted and schemed in such a way so as to produce the end result in the ig’s favor. Everything they do is stink and reeks with manipulation. I-arse came on TV to announce the investigation and the team members have been decided. Taufa was in the scam committee which looked into the 2006 election rigging allegation which ruled that there was rigging in the 2006 election in spite of all observers saying it was fair and free. Taufa concluded with her team that it was not as the observers had declared citing 59 submissions as the basis of her finding. These people in the ig better not fool us with all these staged events its all too predictable and overused. So what is taufas expertise in the field of tax systems. Sweet bugger all I would imagine. Anyway at least the investigations is proceeding albeit with suspect integrity of the inquiry members. There is something about taufa that the ig have some special place for her in their deliberations. I wonder what.

    It is independent because Voreqe did it when Mehen was on leave and we all know that the dictator is independent of the government and the people he has hand picked for appointments, and pays from his slush fund financed by tax payers.

    Wasn’t that an independent team that investigated the GCC, and then Voreqe acted independently of them to appoint himself chairman?

    The all but defunct Charter is also Independent because the co-chair is Voreqe.

    If this was a real INQUIRY, it would be made under the 1997 CONSTITUTION or the COMMISSION OF INQUIRY Act appointed by the diaper pressie – that would make one believe that a Minister would be DISCIPLINED for his breach of the PSC CODE OF CONDUCT AND VALUES ie his lying to FIRCA/Parliament about monies from Haryana and not submitting his tax return BLARRY TAX EVADER, HYPOCRITE!!.

    For a start, a properly legally constituted inquiry would make the process a formal one, with some REAL CONSEQUENCES for Chodo… not just a rubber stamp for their ALREADY HELD VIEWS as you point out SV TEAM. Like the fake FHRC Elections Inquiry (beka ga erections inquiry wouldda made more sense with 2 vaqara oldies Lala and Boleh)

    Let me predict what the verdict of the Inquiry on Chodo will be:-

    “The Commission established during the course of the inquiry that Maiya Chodo had declared all his income correctly and paid all taxes assessed in accordance with the tax laws of Fiji”.

    It is however worrying to note from the terms of reference for the inquiry that although the tax evasion allegations were covered, it totally ignored finding out the source of the funds.

    This is the critical one because ythe tax evasion would have been legally deealth with during the tax amnesty period but the source of the funds would be buried during this fiasco they call an inquiry.

Especially after her stint in the previous scam of an inquiry looking into election irregularities and coming with ridiculous findings and making those damning critical statements on TV. That test is enough for me to give her the thumbs down. Anything to do with the ig has no credibilty full stop. For instance the illegal iAG i-arse extols the ig for having done so much to deminstrate transparency etc and all the flowery rhetorics of self praise.

    Jocelynne Scutt accepted a position as a puisne judge on Fiji’s High Court in November last year, hearing primarily family law matters.

    Her appointment followed the resignation of six expatriate judges from the Court of Appeal last September, amid concerns over the way it was being run under an acting chief judge appointed by the Bainimarama government.

    In Fiji, puisne judges of the High Court can sit as Court of Appeal judges. After the resignation of the Court of Appeal judges, High Court judges have been used to fill the gap on the Court of Appeal. Justice Scutt sat on the Court of Appeal for the first time last month.

    Fiji Women’s Rights Movement spokeswoman Tara Chetty said the group could not support any judicial appointments by the interim government. “It’s easy for women’s groups to be seduced by the appointment of someone with a strong track record in women’s rights,” she said. “Unfortunately, our foundation believes in democracy and the rule of law, so we cannot support the appointment under the current interim regime, which we see as unlawful.”

    She said that since the coup in December 2006, other Australian lawyers and judges had turned down similar offers to serve as judges in Fiji.

    Melbourne criminal barrister Peter Faris QC said it was “odd” to accept the position when others had resigned from it because of government interference or a lack of independence. “It’s a very strange appointment to accept,” he said.

    Barrister Greg Barns said he was surprised Ms Scutt had taken up the position. “I do think Australian lawyers need to be careful with these appointments that they don’t simply get used as propaganda by a particular regime,” he said.

    Last month, a delegation of international law experts was barred from entering Fiji.

    Fiji Law Society president Isireli Fa said he believed the ban was to prevent international scrutiny of the way the interim government was dealing with the country’s courts and legal system.

    A spokeswoman for Foreign Minister Stephen Smith said the Australian Government was concerned about the state of Fiji’s judiciary.

    “The state of the Fijian judiciary is a matter of concern, as evidenced by the fact that most expatriate judges, including a number of Australian nationals, have resigned or have refused to renew their contracts,” she said.

    “The Australian Government continues to urge the Fijian interim government to return Fiji to democracy and the rule of law.” “”

    No matter how the independent enquiry team will try and twist the issue, the case is quite straight forward in the sense that okay, he did not declare his interest income in time BUT sorted out the matter during the amnesty period.

    But the biggest hurdle they will have to overcome is, how did MC source the funds? If it was for the coup victims then he will be charged for fraud since he has been using the money for personal reasons. If he says that the money was given to him as a gift then he needs to provide evidence of the DONORS since the Indian tax authority would be interested since gifts is a deductible expense for tax purposes. If he cannot substantiate the source then he should be taxed on this gift since its from an unidentified source.

    The other issue he will need to justify is, why he did not obtain clearance from the RESERVE BANK for funds in excess of $10,000 being invested offshore?

    The way things are, the best MC should do is to resign as there is no way under the current laws that can save him….

    Update: 12.28pm A former Chief Auditor of FIRCA Lepani Rabo who made several tax evasion allegations against interim Finance Minister Mahendra Chaudhry met the head of the Inquiry Team, Bruce Cowley this morning.

    Speaking to Village news after meeting Cowley at Holiday Inn, Mr Rabo said he had a good discussion with Mr Cowley.

    Mr Rabo said Mr Cowley told him that he had some evidence regarding the alleged tax evasion by Mr Chaudhry.

    He did not accept any documents from Mr Rabo.

    In the update in the Fiji Times, Cowley used to work with Aiarse Khaiyum in Minter Ellison Law Firm in Brisbane.

    The second member Russell Postle works for BDO Kendall which company has a local counterpart operating as BDO Zarin Ali. The senior partner Dr Nur Bano Ali in this firm is Aiarse Khaiyum’s maternal aunty.

    Surprise! Surprise! All within the family and past colleagues. Nothing seems to be transparent and honest in this regime. Frank and Khaiyum and Chaudhry and the whole bunch just stink of corruption and scheming.

    “Cowley has also reportedly done work for Suva lawyer G P Lala who is currently Chaudhrys lawyer in preparing a case of defamation against The Fiji Times.

    “The second member Russell Postle is a partner in the accounting firm of BDO Kendalls of Brisbane.

    “The Fiji BDO accounting practice is managed by Dr Nur Bano Ali, a partner of BDO Zarin Ali and maternal aunt of Sayed-Khaiyum,” said Mr Rae.

    He says the third member Taufa Vakatale is a former wife of Filipe Bole who was FIRCA Chairman until his appointment to interim Cabinet in January this year.

    Ms Vakatale was also part of the rigged Fiji Human Rights Commission 2006 election inquiry which was blatantly pro-Fiji Labour Party.

    “It was Bole who repeatedly stated to the media last year that an inquiry conducted by FIRCA had cleared Chaudhry,” said Mr Rae. “”

    The Fiji Human Rights Commission has condemned a UN committee for questioning its independence and is looking to raise its concerns with the “the highest levels of the United Nations”.

    FHRC lawyers have also been instructed to take legal action against the European Union for its “unconscionable conduct” on the matter, said FHRC chairperson Dr Shaista Shameem.

    Dr Shaista was referring to a recent statement by the UN Committee on the Elimination of Racial Discrimination (CERD).
    The CERD wants Fiji’s interim Government to take all steps necessary to ensure the independence of the commission in accordance with the Paris Principles of 1993.

    Dr Shaista said FHRC is surprised since the CERD committee itself had invited the FHRC to make submissions to it as it examined Fiji Government’s report on the 2006 situation.

    She also accused CERD of dishonesty and of not giving FHRC an opportunity to be heard on the allegations.

    She adds that the CERD committee does not have jurisdiction over national human rights institutions.

    “Its brief is to deal only with States’ compliance with the Convention Against Racial Discrimination,” she said.

    “It has exceeded its jurisdiction by making unsubstantiated comments about FHRC.

    “FHRC also observes that it is ironic that the CERD committee has requested the interim Government to ‘look into’ FHRC’s independence when the validity of the interim Government itself is currently being tested in court.

    “Furthermore, Mr Roger Sykes, the High Commissioner of the UK, the Government currently holding the presidency of the EU, has already stated publicly that his Government does not recognize the interim Government of Fiji; we are at a loss to understand therefore why the EU would want to ask a government it does not recognize to look into the FHRC’s independence.

    “Nevertheless, the FHRC will, if necessary and without hesitation, seek an injunction to prevent the interim Government from interfering with the independence and autonomy of the constitutionally-mandated FHRC.

    “FHRC must be allowed to do its duty in the public interest without fear of repercussions from government or anyone else, including the European Union and the UN. It derives its mandate from the Constitution and no other body.”

    The inquiry team tasked to look into allegations of tax evasion by Fiji’s interim Finance Minister Mahendra Chaudhry is complete and its report given to the interim Prime Minister today.

    The head of the 3-member inquiry team, Brisbane-based lawyer Bruce Cowly and tax specialist, Russell Postle, returned to Austalia this afternoon.

    The third member, former Fiji Education Minister Taufa Vakatale told fijilive that they started their work last Friday and worked right through the weekend, and only completed the inquiry this afternoon.

    She said their report was handed to the interim Prime Minister Commodore Voreqe Bainimarama before they returned to their homes today.

    “You should expect a statement from the Prime Minister on the matter soon,” she said.

    Vakatale adds that the team had all the information they required and did not accept any ‘evidence’ offered by other interested parties, like the former Fiji Islands Revenue and Customs Authority chief auditor Lepani Rabo.

    We only spoke to the people from FIRCA and the Reserve Bank of Fiji,” she said.

    “We did not interview others because this is not a commission of inquiry.”

    Acording to the team’s terms of reference, they are to establish whether Chaudhry’s tax assessment by FIRCA between 2000 and 2006 was carried out in accordance with the Income Tax Act and any other relevant tax laws of Fiji.

    The second terms of reference was to establish whether there were any breaches of the Exchange Control Act by Chaudhry between 2000 and 2006 in relation to the tax assessment carried out by FIRCA.

    Did you guys serious expect the IG to do an independent investigation and inquiry into this matter.

    Just like some of you keep harping about the need transparency and accountability in the IG – why, because they claim that this coup was all about clean-up. This coup was a power grab by one group of chiefs who felt they have been left out for too long.

    The clean-up and transparency was the spin for local consumption, the equality of races, one-man-one-vote – that is for the international crowd.

    How many of you believe that this coup was about “clean-up”.

    And that Vakatale woman – which political party was she from, and who was responsible for her rise – and those folks from Lomaiviti – they kept voting her in – may be they now need to be educated by forums like this.

    BTW – when a Fijian person comes out on the wrong side, you tend to blame the individual, however, when an India or a Muslim does something, you guy seem to have a tendency to blame all Indians or all Muslims.
    Maybe Jean can give us the Social Psychology angle on this one – with her background in the psychology of prejudice.

    lets pray the military with the cowardo voreqe setup their own political party and contest the elections. oH!! they have already setup a party…..SV….new political party called the “National Youth Party” backed by the military and led by prominent QVSOB eg: Jone Navakamocea, Cirikiyasawa, Koyamaibole, etc..

    bodyguard: I doubt very that QVSOB are involved in this National Youth Party if it is backed by the military. Navakamocea was assaulted sometime back at the QVS club due to his involvement with the IG. Can you who Cirikiyasawa and Koyamaibole are.
