It is time

Today they are again pushing us to our limit. How long must we remain silent, stand back and helplessly watch?

This evening Laisenia Qarase was charged with abuse of office dating back to 1992. This is all part of the Charter grand plan to charge the key SDL people of some charges and therefore disqualify them from standing in the next election.

And we have just received words now that Russel Hunter, the publisher of the Fiji Sun has just been taken away by some people claiming to be immigrations officials. Upon enquiry with Director of Immigration Naupoto, he was surprised and said he did not know of any immigration raid on Russell.

There is only one way we can bring this regime down. Let us take to the street in mass protest and have them try and arrest us all.

Korovou, Naboro, Natabua cannot even take it if 20,000 of us descend upon the streets of Suva and Lautoka.

We are not calling for violence, just massive passive resistance. With this suggestion, let me take you back to India on the 23rd of March 1922. Mahatma Gandhi stood before the judges and in his speech before being sentenced for sedition he addressed the court and said:

“Non violence is the first article of my faith. It is the last article of my faith. But I had to make a choice. I had either to submit to a system which I considered has done an irreparable harm to my country or incur the risk of the mad fury of my people bursting forth when they understood the truth from my lips. I know that sometimes my people have gone mad. I am deeply sorry for it; and I am therefore, here, to submit not to a light penalty but to the highest penalty. I do not ask for mercy. I do not plead any extenuating act. I am here, therefore, to invite and submit to the highest penalty that can be inflicted upon me for what in law is a deliberate crime and what appears to me to be the highest duty of a citizen. The only course open to you, Mr Judge, is, as I am going to say in my statement, either to resign your post or inflict on me the severest penalty if you believe that the system and law you are assisting to administer is good for the people. I do not expect that kind of conversion. But by the time I have finished with my statement you will, perhaps, have a glimpse of what is raging within my breast to run this maddest risk which a sane man can run”.

I plead to you citizens. It is now time to think of our children and our future.

Are we just going to stand by and watch helplessly while the Vore and the Snake plunder, pillage and bare false witness on innocent people.

If you do not step up now and move in unison to make the change, then you or your wife or your son or daughter will be next. Rounded up in the middle of the night, beaten to death and then dump back on you doorstep at sunrise.

I therefore appeal to you all. Mai Ragone. Let us all get arrested, charged and plead for the harshest sentence. Lets gnaw at the conscious of the judges that will sentence us. Lets fill up the gaols to the seem. Lets push their resources to the limit. Lets get 20,000 or 30,000 arrested. Lets voluntary go into the prisons and crack their budget on money to feed us  and break this butako governments budget.

If we do it in unison for just a day or two we will break this illegals.

    It is used to divert attention from the regimes major fuck-up,in this case ,Chodo’s exposure as the tax evading dog.

    They used it previously with their ”assasination conspiracy” but we all know how that case will end up,in the garbage.But whatever they do ,lets keep this fiasco in the forefront of efforts to bring this regime down

    I recall a response Mr Qarase gave at the aborted political forum of PCPI recently. Asked as to why he has in his party some who have been convicted for the 2000 crisis, Mr Qarase responded; They have served their time, and at least they didn’t run to the president for amnesty. They welcomed the prosecution and have served their time.” On the same light, if I’m Mr Qarase, I would welcome the prosecution, based as it is on filmsy and questionable evidence. This is the chance to get his name cleared once and for all, and although it may be painful for his family, it will also be a chance to get some money at the same time, when he sues the pants out of this regime. For that he is being a true man, and leader. Unlike those who continue to hide behind amnesties and so called facades of secrecy or confidentiality!

    On a side issue I can see one similarity with the snake and the pig. Both have eliminated dissenters among their ranks to command outright loyalty from the remaining followers. Have you noticed that the FLP has no more founding member except for the snake himself. Both the snake and pig have dictator style leadership which is bad for the country. Many good members of FLP have been ousted by the snake and all there is left are stooges like JK, LP, LRV, FA, all talks with shallow intellect. No more Dutt, Bune, Atu Bain. What a pity these people could have contributed a lot for the country instead of the useless lot clinging on to these dicktakers.

    I have read the charges that have been laid against the Prime Minister of Fiji.

    As one of Her Majesty’s justices in Australia, I would be bound to ask the prosecution for more details as there is no substance in what they presented. The case should have been dismissed and the prosecution taken to task for wasting the court’s time.

    The only reason that the flimsy case against the Prime Minister is continuing is that it was heard by one of chaudhry’s juntas illegally appointed magistrates.

    The impartiality is frightening

    It is ok that they have charged Qarase and the onus is on them to prove the allegations.

    But we hope that the same treatment is given to all the people who break the law. At the moment we cannot say that everybody is being treated equally because this regime is still turning a blind eye to the corruption being committed by this crook Maiya Chodo.

    The whole bang lot in the Police, Military, and FICAC are just as corrupt at the moment because they are ignoring corruption right at their doorstep.

    As long as these abuses like the treatment of Russel Hunter and others whose rights have been violated continue to happen without any condemnation by the iPM and his Cabinet the Fiji interim Regime will not have any credibility.

    The people are watching and things are going from bad to worse.

Look at Burma, Tibet, Kenya, Pakistan, Palestine, Cuba. The international community and the UN are toothless these days, and we shouldn’t look to them to get us out from under the Pig/Snake junta. We have to do it ourselves. Who should we march to? No point going to Parliament or Berkley Crescent. What about the EU HQ? Forum Sec? Aussie embassy? Let’s do this!!

    The publisher and chief executive officer of Sun (Fiji) News Ltd, Russell Hunter is expected to leave the country this morning, says the newspaper’s editor Leone Cabenatabua.

    Cabenatabua told Fijilive that they checked with Air Pacific this morning and were told that Hunter’s name is on the list for the 9am flight to Australia.

    “We tried to contact Hunter but his mobile is diverted,” he said.

    Cabenatabua said they suspected Hunter was taken because of the articles the newspaper published on the tax evasion story against an interim minister.

    He said that seven men, who said they were immigration officials, took Hunter from his Ragg Avenue home in Suva at around 8.30pm yesterday for questioning.

    “His wife and daughter are still here with me,” said Cabenatabua.

    He said that Hunter’s whereabouts is yet to be established.

    “His family is very worried,” said Cabenatabua.

    The Immigration director Viliame Naupoto could not be reached for comments.

    Meanwhile, the military spokesman Lieutenant Colonel Sitiveni Qiliho told Fijilive that they have no knowledge of this.

    “No, he was not taken to the camp,” said Qiliho.

    Hunter is an Australian expatriate who had just got his contract with the newspaper company extended for another three years beginning last year.

    My apologies for butting in on your website. I have been a reader for sometime but normally refrain from making comments. However the events of the past week has convinced me to change my mind.

    Often I am amazed at the information your contributors come up with and in this vein would like to ask if there is any truth about the former journalist Asha Lakhan’s employment by John Sammy at the NCBBF to head their media liaison unit. It is supposed to be a 10 month contract for the sum of FJ$100,000.

    Also please watch the news in the next couple of hours. Russell Hunter was on the FJ service to SYD this morning and will be met by a big contingent of Australian media. FJ crew sources say he was seated next to American Ambassador Larry Dinger and the Fiji Sun marketing director. If you have sources at FJ reservations could someone find out who paid for Russell’s business class ticket.

    Please pray for the safety of his wife and daughter who are still in Fiji.

    When Village News called the Fiji Human Rights Commission to comment on the deportation of Fiji Sun Publisher and Managing Director this morning, the Chairperson Dr Shaista Shameem referred our Village reporter to the Constitution.

    Doctor Shameem said if the family thinks that Hunter’s rights were violated they are free to refer to Section 23 1 (i) of the Constitution and take the matter up with the appropriate authorities.

    Section 23 1 (i) states: A person must not be deprived of personal liberty except: for the purpose of preventing the unlawful entry of the person into Fiji or of affecting the expulsion, extradition or other lawful removal of the person from the Fiji Islands.

    The charges against Qarase are as strange as they seem:

    - Count one Officer charged with administration of property of a special character or with special duties contrary to section 109 of the Penal Code. The charge sheet reads that between 1992-1995, Qarase as director of FHL, member of the Fijian Affairs Board and advisor to the GCC, bought 200,000 Class A shares from FHL for his family company Q-Ten Investments Limited.

    - Count two Abuse of office contrary to Section 111 of the Penal Code. As director of FHL, member of FAB and advisor to the GCC, Qarase in 1992, applied for shares from FHL for Q-Ten Investments and, in his capacity as director approved the allotment of shares without declaring his interest to FHL, FAB and the GCC.

    - Count three Abuse of office, contrary to Section 111 of the Penal Code. As director FHL, FAB member and GCC advisor, Qarase between November 1991 and June 1992, applied through Cicia Plantation Co-op Society Limited for Class A shares in FHL and approved the allotment of shares to the company in his capacity as a director FHL. He carried this out without declaring his interest in CPCS to FAB, FHL and GCC.

    - Count four Abuse of office contrary to Section 111 of the Penal Code. Mr Qarase as director FHL, advisor to the GCC and FAB member applied for Class A shares at FHL through Mavana Investments Limited. He approved the allotment and at the same time failed to disclose his interest in Mavana Investments Limited to FHL, FAB and GCC.

    So let’s see the Penal Code offences named In the charges:

    109. Any person who, being employed in the public service, and being charged by virtue of his employment with any judicial or administrative duties respecting property of a special character, or respecting the carrying on of any manufacture, trade or business of a special character, and having acquired or holding, directly or indirectly, a private interest in any such property, manufacture, trade or business, discharges any such duties with respect to the property, manufacture, trade or business in which he has such interest or with respect to the conduct of any person in relation thereto, is guilty of a misdemeanour, and is liable to imprisonment for one year.

    111. Any person who, being employed in the public service, does or
    directs to be done, in abuse of the authority of his office, any arbitrary
    act prejudicial to the rights of another, is guilty of a misdemeanour.

    If the act is done or directed to be done for purpose of gain, he is guilty of a felony, and is liable to imprisonment for three years.

    A prosecution for any offence under this or either of sections 109 or 110 shall not be instituted except by or with the sanction of the
    *Director of Public Prosecutions.
    * Amended by Order 8th October, 1970.

    Section 109 can only refer to actions that Qarase was supposed to have taken after the purchase of the shares. But no actions are specified in the charges. What the charge is saying is that it was against the law to buy the shares, yet the Penal Code offence says that having an interest, ie already having the ownership of the shares, duties as a public servant are discharged in a way that involves a conflict of interest. The obvious questions are: was Qarase a public servant as a member of the FAB, a director of FHL or adviser to the GCC? What conflict of interest did he encounter in any of those roles? Section 109 does not make it an offence to buy shares.

    The charges in relation to Section 111 again assume that the mere purchase of the FHL shares was “prejudicial to the rights of another”.
    It also assumes that Qarase was a public servant.

    Finally, it is clearly set out that prosecution for the offences is to be brought by the DPP. Presumably the FICAC “legislation” amends this act, just as it empowers Langman and others to carry out their duties lawfully. This will be a quick test for the badly interfered with judiciary. A similar prosecution was thrown out last year on just these grounds.

    This is desperate stuff. It has taken a year to lay the charges. The FHL records were some of the first illegal acts of FICAC. Why so long? They had all they needed to lay charges but didn’t lay them?

    Could it relate to the Chaudhry scandal? That is, of course, a rhetorical question, but I suspect the conspirators may have been saving these charges for a time closer to an election, pulling them out at the last minute to try to prevent Qarase standing. They know that a conviction would not be possible but the laying of charges could hold up nomination. With the Chaudhry scandal the whole game has suddenly become more desperate. Even these flimsy charges have to be wheeled out to stave off a complete breakdown in the regime.

    Everybody involved in this charade should carefully consider their responsibility. Sure, Chaudhry and Frank are going to go away for a long time, together with Gates, Sayed-Khayum and Nazhat Shameem. But don’t forget that “swearing an illegal oath” in the 2000 events drew prison sentences. Langman, in particular, should be feeling a tightening feeling around his neck. Obeying orders won’t wash.

    BTW - didn’t I tell you guys, those FLP guys, they will look the other way on Chaudary offshore bank accounts - just like we will look the other way no matter what they did up on Qarase.

    May be someone can read up on the MLK marches in the US south, or the Ghandi marches against the British - totally non-violent and definitely no booze as someone suggested.

Get one central organiser or two etc..they corrdinate the group leders efforts. Get the numbers for each group to the central organisers so you know the numbers . each group responsible for organisation and plan for theior own big groups etc..Once you identify each group (vanua, church etc) they will work through the network for instructions and plan. Only the top organiser and top leader for each group to meet at top level. others at own level. Only the top leaders can talk to other group leader. others work only in their network.. etc.. stealth, plans, goals, time, support services, etc must be planned and idscussed by the leaders. Internet and blog is monitored.. etc..just some ideas to assist

    By marching and doing things like that, all you would be doing is giving them an opportunity to vent their frustration.
